The
Petition for Trade Adjustment Assistance (TAA) and
Alternative Trade Adjustment Assistance (ATAA) form
explains who can file a petition and when a petition can be
filed. TAA/ATAA petitions may also be obtained from any
local Iowa Workforce Development (IWD) office, the State TAA
Office, or the U.S. Department of Labor’s Division of Trade
Adjustment Assistance.

When the petition is received, the Trade Act Coordinator
will review it and submit it to the appropriate division of
the Department of Labor (DOL) in Washington, D.C. Upon
receiving the petition from the State TAA office, the DOL
conducts a fact-finding investigation to determine whether
the group eligibility criteria have been met.
Within approximately 40 days of the State TAA Office’s
submission of the petition, the DOL will conclude the
investigation and issue a final determination based on the
TAA/ATAA eligibility requirements. If a final determination
is not reached within 40 days, this delay is typically
because the DOL is having difficulties obtaining the
required information from the affected company. When the
final decision is reached, the DOL will notify the
petitioners and the State TAA Office.
If the DOL determines that a TAA/ATAA petition does not meet
the eligibility requirements under the Trade Act program,
then the petition for Trade Act certification is denied.
If the DOL certifies, or approves, a petition, the Trade Act
Coordinator will make contact with the petitioners and
company to set up worker information meetings to assist
affected workers in completing their eligibility paperwork
and to notify them of the menu of benefits available to help
them in finding new employment.
