Question: I'm applying for a job but the ad says they don't hire smokers. Is that legal?
 
Answer :
At this point in Iowa, it is NOT illegal for an employer to simply say, we do not employ smokers, or to use ads that say smokers need not apply. Some states have laws that say you cannot discriminate against an individual on the basis of their "legal odd-duty conduct." Thus, since smoking is NOT illegal -- it is considered illegal in those states to refuse to hire someone on the basis of their "legal off duty" conduct of smoking. Not surprising some of those are states where tobacco is grown. Iowa does NOT have such a law. Thus, an inquiry about smoking or a prohibition against hiring smokers is not on its face illegal in Iowa.
