Is my employer required to pay me for the period that I am away from work performing military training or service?
USERRA does not require an employer to pay an individual for time not worked due to service. If you are exempt from the Fair Labor Standards Act (FLSA) overtime rules (because you are a manager, for example), the employer is not permitted to make a deduction for a part of a pay period missed because of temporary military leave. This is an FLSA requirement, not a USERRA requirement.
